TÜV SÜD Foundation (in German: TÜV SÜD Stiftung) would like to provide you with relevant information on our projects and activities. Established in late 2009, the TÜV SÜD Foundation promotes technology and technical safety across all spheres of society. The Foundation consistently advances TÜV SÜD’s founding idea, dating back to 1866, of harmonising the needs of people, the environment and technological progress in order to make the world a safer place. The Foundation believes that our society needs people who are fascinated by technology and show an understanding of the field – as well as communicate it. By funding an array of projects, TÜV SÜD Foundation helps to generate enthusiasm for modern technology and natural sciences among young people in particular. In as far as the TÜV SÜD Foundation processes any personal data, this is done for one of the purposes given in this privacy statement.

This privacy statement therefore explains the types of your personal data that are processed by the TÜV SÜD Foundation when you use our offers and services. We will process your personal data exclusively in compliance with the applicable legal data protection requirements, in particular the European General Data Protection Regulation (hereinafter “GDPR”) and the German Federal Data Protection Act (hereinafter “BDSG”). TÜV SÜD Foundation does not offer any newsletters.

Our website uses social media buttons. The buttons show the logos of the respective social network. Please note that these buttons are only icons with embedded links. They are not social plugins. When you click one of these buttons, you leave our website, and thus our sphere of responsibility.

6. Transfer to third countries

In some cases, we may have to transfer your personal data to a TÜV SÜD company located in a third country. In these cases, we will only transfer your data with your consent (Art. 49 (1) lit. a GDPR) or if such transfer expressly results from our contract with you or your company (Art. 49 (1) lit. b or c GDPR).

In some cases, we use services on our website that are hosted in, or process data in, third countries. These third countries cannot always furnish evidence of adequate data protection standards (adequacy decision) and are therefore considered to be of particular concern under data protection law. Given this, we have concluded standard data protection clauses in accordance with Art. 46 (2) lit. c GDPR with the providers of these services. On request, we will provide you with a copy of the standard data protection clauses concluded with the individual providers.

7. Other uses of data, automated decision-making, profiling

Any further processing of your personal data will generally only be carried out to the extent permitted on the basis of a legal regulation or where you have consented to data processing or data use. In the case of further processing for purposes other than those for which the data were originally collected, we will inform you about these other services and provide you with all other significant information before further processing. In these cases you are under no obligation, either legal or contractual, to disclose your data.

In accordance with Art. 22 (1) (4) GDPR, no automatic decision-making, including profiling, will be undertaken within the scope of your visit to this website.

8. Further recipients or categories of personal data (if any)

Your personal data are passed on to law-enforcement authorities where this is necessary to clarify unlawful use of our services or for the purpose of asserting our legal rights. However, such a transfer will only take place if there is concrete evidence of illegal conduct or misuse. A transfer of personal data can also take place where this helps to enforce the terms and conditions of use or other agreements. We are also under legal obligation to provide information to certain public bodies on request. 9.1. Right of access

As the data subject, you have a right of access to personal data provided the conditions set forth in Art. 15 GDPR apply.

This primarily means that you are entitled to obtain confirmation from us as to whether we process your personal data. If this is the case, you are also entitled to information about these personal data and the information listed in Art. 15 (1) GDPR. This includes, for example, information about the purposes of processing, the categories of the processed personal data concerned, and the recipients or categories of recipients to whom the personal data have been or will be disclosed (Art. 15 (1) lit. a, b and c GDPR).

9.2. Right to rectification

As the data subject, you have a right to rectification provided the conditions set forth in Art. 16 GDPR apply.

This primarily means that you are entitled to obtain from us the rectification of inaccurate personal data or completion of incomplete personal data concerning you without undue delay.

9.3. Right to erasure

As the data subject, you have the right to erasure (“right to be forgotten”) provided the conditions set forth in Art. 17 GDPR apply.

This means that you have the fundamental right to obtain from us the erasure of the personal data concerning you without undue delay and that we have the obligation to erase personal data without undue delay where one of the grounds listed in Art. 17 (1) GDPR applies. This can be the case, for example, if the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.

In as far as we have made your personal data public and are obliged to erase them, we are also obliged, taking account of available technology and the cost of implementation, to take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the data subject has requested the erasure of any links to, or copy or replication of, those personal data (Art. 17 (2) GDPR).

By way of exception, the right to erasure (“right to be forgotten”) shall not apply where, and to the extent that, processing is necessary on the grounds listed in Art. 17 (3) of the GDPR.

9.4. Right to restriction of processing

As the data subject, you have a right to data portability provided the conditions set forth in Art. 20 GDPR apply.

This means you have the fundamental right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from us in as far as processing is based on consent pursuant to Art. 6 (1) lit a or Art. 9 (2) lit. a GDPR or on a contract pursuant to Art. 6 (1) lit b GDPR and the processing is carried out by automated means (Art. 20 (1) GDPR).

9.6. Right to object

As the data subject, you have a right to object provided the conditions set forth in Art. 21 GDPR apply.

When we first communicate with you as the data subject, we will expressly draw your attention to your right to object.

As the data subject, you have the right to object at any time, on grounds relating to your particular situation, to processing of personal data concerning you which is based on Art 6 (1) lit. e or f GDPR.

If you object to data processing on grounds relating to your particular situation, we will desist from processing your personal data unless we can demonstrate compelling legitimate grounds for data processing which override your interests, rights and freedoms, or unless processing is for the establishment, exercise or defence of legal claims.

9.7. Right to withdraw consent

As a data subject in accordance with Art. 7 (3) GDPR, you are entitled to withdraw your consent at any time where processing is based on your consent in accordance with Art. 6 (1) lit. a or Art. 9 (2) lit a GDPR.
